By accessing or using thevisajourney.com (the “Site”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, do not use the Site.

 

1) Introduction & Agreement

Celestial Compass LLC (“we,” “us,” “our”) operates thevisajourney.com, a WordPress blog that shares firsthand immigration experiences and provides scheduling for brief Peer Insights Sessions. Content is experience-based information only and not professional counsel. By accessing the Site or booking a session, you agree to these Terms.

2) Eligibility & Accounts

You must be 18 years or older to use the Service. If you create an account, you agree to:

  • Provide accurate information.

  • Keep your login secure.

  • Promptly update any changes.
    You are responsible for all activities under your account.

3) Content & No Legal Advice

ALL CONTENT IS FOR INFORMATIONAL PURPOSES ONLY and reflects personal experiences. IT IS NOT LEGAL, IMMIGRATION, OR PROFESSIONAL ADVICE. NO ATTORNEY-CLIENT RELATIONSHIP IS FORMED. You must verify requirements with official sources (e.g., USCIS, U.S. Department of State/consulates) and consult a qualified professional for advice. We are not affiliated with USCIS, DHS, DOS, or any government agency.

4) Experience Q&A Session

  • Scope: Sessions are limited to sharing the consultant’s recent personal experiences. No legal advice, document review, form preparation, case-specific strategy, or outcome guarantees.

  • Scheduling: Sessions are booked via Bookly. Time starts at the scheduled minute.

  • Lateness & No-Show: If you are late, the session still ends at the scheduled time. A no-show after 10 minutesends the session with no refund.

  • Cancellations/Rescheduling: You may reschedule once if requested at least 24 hours before the start time. Cancellations are non-refundable except where required by law. If we cancel, you may choose a full refund or a new time.

  • Recording: Recording (audio/video/screen) is prohibited without prior written consent from both parties. Unauthorized recording, publication, or distribution is forbidden.

  • Follow-Up: We may send a brief recap (if offered), but no ongoing email advice is provided. Further questions require a new booking.

5) Payments, Pricing, Taxes & Refunds

  • Price: $9.99 (USD) per 15-minute session, unless otherwise posted. Taxes may apply.

  • Processor: Payments are handled by Stripe; you agree to its terms and privacy policy. Charges occur at booking; receipts are sent to your email.

  • Refunds: Fees are non-refundable except where required by law or if we cancel your session.

  • Chargebacks/Disputes: Contact us first at Contact Page. Unfounded chargebacks may result in account suspension; we may contest chargebacks with evidence.

6) User Conduct & Acceptable Use

You agree not to:
a) Violate laws or rights.
b) Harass, threaten, or defame others.
c) Post others’ personal/confidential data without consent.
d) Upload malware.
e) Misrepresent your identity.
f) Scrape, crawl, or use automated access without permission.
g) Use Site content to train AI models or build derivatives without our written consent.
h) Spam or interfere with the Service.

7) User Submissions & License

If you submit stories, comments, or other content (“User Content”), you represent and warrant that you own or control all necessary rights and that it does not infringe intellectual property rights, violate privacy, or breach any law. By submitting User Content, you grant thevisajourney.com a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to host, store, reproduce, adapt for formatting, publicly display, distribute, and promote your User Content in connection with the Service. We may moderate submissions, edit for clarity/length, or remove content at our sole discretion.

8) Intellectual Property

All Site materials (text, graphics, logos, design, software) are owned by Celestial Compass LLC or its licensors and protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to access and use the Site for personal, non-commercial purposes. You may not copy, reproduce, publicly display, distribute, mirror, or create derivative works without prior written consent.

9) Third-Party Links & Services

The Service may link to third-party sites or tools (e.g., scheduling, payment, video platforms). We are not responsiblefor their content, policies, or availability.
Affiliate Disclosure (if applicable): We may use affiliate links and could earn commissions at no extra cost to you.

10) Privacy & Data

Your use is subject to our Privacy Policy. Scheduling and payment data are processed by third parties (e.g., Bookly, Stripe) under their own policies. Do not share sensitive personal data you do not want processed.

11) Disclaimers

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
NO GUARANTEES: WE DO NOT GUARANTEE ACCURACY, COMPLETENESS, TIMELINESS, APPROVALS, OR OUTCOMES. CONTENT MAY BECOME OUTDATED.
TECHNOLOGY & AVAILABILITY: THE SERVICE MAY EXPERIENCE INTERRUPTIONS, ERRORS, OR DATA LOSS. YOU ASSUME ALL RISK FROM YOUR USE.

12) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Celestial Compass LLC, ITS OWNERS, OFFICERS, AND AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; FOR RELIANCE ON INFORMATION; MISSED DEADLINES; IMMIGRATION OUTCOMES; LOST PROFITS; LOST DATA; OR SERVICE INTERRUPTIONS. IN ANY EVENT, OUR AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF (A) $25 OR (B) THE AMOUNTS YOU PAID TO US FOR SERVICES IN THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.

13) Indemnification

You agree to defend, indemnify, and hold harmless Celestial Compass LLC and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your User Content, or your violation of these Terms or applicable law.

14) Governing Law, Dispute Resolution & Venue

These Terms are governed by the laws of the State of Florida, U.S.A., without regard to conflict-of-law rules. The Federal Arbitration Act (FAA) governs the interpretation and enforcement of the arbitration agreement below.
Arbitration: Except for small-claims and injunctive-relief matters, any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association (AAA)under its Consumer Arbitration Rules, as modified by these Terms. The arbitration will be conducted in English by a single arbitrator, with the seat and venue in Broward County, Florida, or remotely by video at the arbitrator’s discretion.
CLASS ACTION WAIVER: YOU AND WE AGREE TO RESOLVE DISPUTES ONLY ON AN INDIVIDUAL BASIS; NO CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTIONS.
Small-Claims Carve-Out: Either party may bring an individual claim in small-claims court in Broward County, Florida.
Court Venue: For any permitted court proceedings (e.g., to enforce an arbitral award or seek temporary/injunctive relief), the exclusive jurisdiction and venue will be the state and federal courts located in Broward County, Florida, and each party consents to personal jurisdiction there.
Arbitration Opt-Out (Optional): You may opt out of arbitration within 30 days of first accepting these Terms by emailing support@thevisajourney.com with the subject line “Arbitration Opt-Out” and your full name and the email tied to your account. Opting out does not affect other provisions of these Terms.

15) Modifications to the Service & Terms

We may update content, features, pricing, and these Terms at any time. Changes take effect when posted with a revised “Last Updated” date. We may provide notice via the Site or email. Your continued use after changes means you accept the updated Terms.

16) Termination

We may suspend or terminate access immediately for any reason, including violations of these Terms, suspected fraud, or harm to other users or the Service. Upon termination, your license ends and certain provisions will survive.

17) Severability, Waiver, Assignment, Entire Agreement

If any provision is held invalid, the remainder remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or successor. These Terms (plus any referenced policies) constitute the entire agreement between you and us regarding the Service.
Survival: Sections 3, 5, 7–14, and this Section 17 survive termination.
